Is It Legal to Buy Cannabis Seeds in Spain?

Spain has many independent regions, so different areas have different weed laws. That said, all of Spain has become more relaxed with their cannabis laws over the last few years specifically, but in some areas of the legislation, things also seemed to have moved backward a bit. This leaves a lot of questions with questionable answers, including the legality of buying cannabis seeds.

Is it legal to buy cannabis seeds in Spain? The short answer to this question is yes. However, it depends on where you are and how you are buying them. Spain has a lucrative black-market, but this is not a legal way to purchase cannabis seeds. There are specific sites for purchasing cannabis seeds in Spain, and this is one of the only ways to do so legally, at least right now.

Cannabis laws tend to change quickly, so it is always good to stay updated on the laws relatively often, especially if you are about to travel to someplace like Spain. For now, though, there are a few ways you can purchase cannabis seeds legally. Aside from one of the designated purchasing sites, it is also legal to buy seeds if you are using them for a government approve reason. If you are purchasing seeds as a cannabis club, or for medicinal or research purposes.

How to Legally Buy Cannabis Seeds in Spain

Before you decide to purchase cannabis seeds for personal use, it is important to know all of the laws surrounding cannabis in Spain. You don’t want to make the mistake of assuming and risking getting in trouble with law enforcement, while in most cases you would be slapped with a fine, there are some cases that are taken more seriously. Landing yourself with a criminal record is something no one ever wants.

Although possessing and smoking weed in public is still illegal in Spain, there are a few different ways that you can grow, smoke, and even buy cannabis seeds. Granted, Spain is a decentralized country, so laws in different regions will vary. That is the main reason why it is so important to stay updated on the current legislation. Not just for Spain in general, but the region you live in or will be traveling to.

The different scenarios in which you can find your way around the laws and legally buy cannabis seeds in Spain are:

  • For personal use
  • If you own a cannabis club
  • For medicinal or research purposes

 For personal use:

If you are buying cannabis seeds for personal use, just know that no matter what area you live in, you could be putting yourself at risk. Buying seeds, cultivating, and smoking cannabis isn’t necessarily illegal for personal use, but it isn’t necessarily legal either. There is a grey area that lies within the personal use of cannabis in Spain. The law doesn’t directly state for or against the legality of using cannabis for personal use.

Because of this, people in Spain have begun to smoke and grow cannabis for personal use within the comfort of their own homes. If you decide to do this, though, you must make sure it is out of the vision of the public. It is also advised to keep an eye on the smell because if your neighbors complain about a smell, you could be visited by law enforcement shortly after. However, one or two plants usually aren’t enough to cause concern with the neighbors.

To clarify, when it comes to buying cannabis seeds, if you only buy enough for personal use, then you fall under this grey area of the legislation. As long as you can prove that your purchase is for personal use, then law enforcement can’t and won’t do anything about it. That said, don’t push the limits on how many plants/seeds constitutes for personal use. At the end of the day, it is the word of law enforcement against yours.

If you wish to purchase cannabis seeds, there are a couple of reliable and legal websites to do so. This is something also to be wary of because there are a lot of black-market sites you want to stay away from, as these are illegal. Two reliable and legal sites for buying cannabis seeds are:

MSNL Marijuana-seeds.nl – They are based out of London, UK and have been in the industry since 1999.

Sensi Seeds- They are based in The Netherlands and have been around since 1985.

Cannabis clubs

Cannabis clubs have been popping up all over Spain within the last few years, especially in Barcelona. These clubs allow for a convenient and legal private option for people to come and buy and smoke marijuana. You must be an adult with a membership to each establishment you wish to visit, but they fall under the same law that allows you to cultivate and smoke in private and personal settings.

In today’s legislation, because there are so many cannabis clubs now, they have a set of rules they also have to abide by. You can leave those details to the owners though, all you have to worry about is the quality and price you are receiving.

Cannabis clubs grow their own weed and sell it to their customers. All weed is grown in private and only sold through the establishment. Each club is allowed to grow 159 kilograms per year for its members. These establishments also need a way to purchase cannabis seeds. All cannabis clubs are supposed to purchase their seeds through one of the approved websites, as well. This is because everything must be documented for the business.

Medicinal and research purposes:

Medicinal and research growing operations are handled pretty much the same way. These are government-approved companies that are cultivating marijuana for the medical marijuana community in Spain or for further research into the medicinal benefits. These types of companies are approved by the government to purchase cannabis seeds and grow them. They are also allowed to do so in larger quantities because of their government approval status.

There are only a few medical and research marijuana facilities throughout Spain, but they, too, go through approved websites to purchase their seeds.

Is It Legal to Sell Cannabis Seeds in Spain?

Unfortunately, because of the overall legal status of marijuana in Spain, it is illegal to sell cannabis seeds. This is because if you are growing cannabis with the intent to sell, you are then breaking the law. Cannabis clubs can sell weed and weed-related products, but they cannot sell seeds.

The bottom line is this, if you are traveling to Spain for an extended amount of time, then your best bet for weed is through a cannabis club. If you live in Spain, your best bet is also through a cannabis club. That said, though, if you decide to start cultivating your own weed for personal use, then it is highly advised that you only grow one or two plants. It is also advised that you go through one of the sites listed above to order your seeds.

If you live in Spain and would like to get involved in researching the medicinal benefits of consuming marijuana, it is highly encouraged. The more we know about this plant, the better. If we want to continue to see the laws towards consumption and possession of weed becoming more lax, then we have to play our part in proving its legitimacy.
